Terms of Service

Welcome to the website of Newtop Machinery. By accessing our website, requesting a quote, or purchasing machinery from us, you ("the Buyer" or "User") agree to be bound by the following Terms of Service ("Terms"). Please read them carefully before placing an order.

1. Product Information & Modifications

We strive to ensure that the technical specifications, photos, and videos of our machinery (e.g., Flexo Printers, Bag Making Machines) are accurate. However, due to continuous R&D and technical improvements:

• Upgrades: Newtop Machinery reserves the right to modify machine designs, colors, or technical parameters without prior notice, provided that these changes do not degrade the machine's performance.
• Customization: For customized orders, the final specifications shall be subject to the signed Sales Contract or Proforma Invoice (PI).

2. Pricing and Payment Terms

Unless otherwise stated in a written contract:

• Currency: All prices are typically quoted in USD or RMB.
• Validity: Price quotations are valid for a specific period (usually 30 days) due to fluctuating raw material costs and exchange rates.
• Payment: Standard payment terms are a 30% deposit via T/T to confirm the order, with the remaining 70% balance payable before shipment. We also accept Irrevocable L/C at sight for larger orders, subject to negotiation.

3. Shipping and Delivery

• Incoterms: We typically operate under FOB (Free on Board), CIF (Cost, Insurance, and Freight), or CFR terms.
• Lead Time: Estimated production times (e.g., 30-45 days) are estimates only. While we make every effort to deliver on time, Newtop Machinery is not liable for delays caused by Force Majeure, shipping carrier delays, or customs clearance issues.
• Risk Transfer: The risk of loss or damage to the goods passes to the Buyer in accordance with the agreed Incoterms (e.g., upon loading onto the vessel for FOB).

4. Warranty Policy

We provide a limited warranty for our machinery to ensure your peace of mind:

• Duration: The standard warranty period is 12 months from the date of Bill of Lading (B/L).
• Coverage: The warranty covers defects in materials and workmanship for main parts (e.g., PLC, Motor, Servo Driver).
• Exclusions: The warranty does NOT cover:
  • Consumable parts (e.g., blades, belts, heating elements, rubber rollers).
  • Damage caused by improper operation, unauthorized modifications, or failure to maintain the machine.
• Claim Process: If a part fails during the warranty period, we will provide a free replacement via courier. The Buyer may be asked to send photos/videos for engineering analysis.

5. Installation and Technical Support

For complex machinery, we offer overseas installation and training services:

• Online Support: Free lifetime technical support via video call or WhatsApp.
• On-Site Service: Upon request, we can dispatch engineers to the Buyer’s factory. The Buyer is responsible for the engineer's round-trip air tickets, visa fees, local accommodation, and a daily service allowance (as specified in the contract).

6. Limitation of Liability

To the maximum extent permitted by law, Newtop Machinery shall not be liable for any indirect, incidental, or consequential damages (including loss of profits, production downtime, or business interruption) arising from the use or inability to use our machinery.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the People's Republic of China. Any disputes arising from these Terms or related sales contracts shall be settled through friendly negotiation or, failing that, by the competent court in the seller's location.
